Current Enforcement Trends for Tracking Technologies

BDO Free CPE Webinars

March 24 @ 12:00 pm 1:00 pm EDT

Free 1 CPE credit

Investigations, enforcement actions, and lawsuits focused on the use of website and mobile app tracking technologies are accelerating globally—specifically related to consent, notice, data sharing, and sensitive data collection. As tracking stacks become more complex with the use of pixels, software development kits (SDKs), tags, session replays, analytics, and advertising identifiers, organizations are increasingly expected to demonstrate a clear technical understanding of what data is collected, where it is sent, and how controls are implemented and monitored.

In this webcast, presented by BDO USA and ObservePoint, we will review current enforcement trends affecting tracking technologies and break down what these developments mean in practice for privacy, legal, compliance, and digital teams. The session will connect emerging regulatory expectations with real-world response approaches—such as maturing consent and preference management, strengthening vendor oversight, validating tracking behavior through technical testing, and improving governance and documentation to withstand scrutiny. Attendees will leave with actionable insights to help assess risk, prioritize remediation, and prepare for regulator or plaintiff inquiries.

1.0 CPE Credit in the field of Specialized Knowledge (SK)

Learning Objectives

  • Identify major enforcement themes related to tracking technologies (websites and mobile apps), including common allegations tied to consent, notice, data sharing, and cross-border data transfers.
  • Explain the technical fundamentals of common tracking tools (e.g., pixels, SDKs, tags, session replays) and evaluate how these technologies impact compliance risk through data mapping and validation/testing approaches.
  • Apply practical response strategies to reduce exposure and improve readiness—such as strengthening consent and cookie governance, enhancing vendor/third-party controls, and improving documentation and incident/inquiry response playbooks.
