Introduced in November 2017, the DOJ’s new Foreign Corrupt Practices Act (FCPA) Corporate Enforcement Policy (the policy) made significant changes to some areas of previous policy while leaving others alone. How has it played out? We’ll discuss:

  • An overview of the differences between the earlier pilot program and the new policy.
  • Compliance challenges and complexities companies have faced under the policy, including the DOJ’s expectation that, as part of remediation, companies prohibit the use of software and apps that do not retain business records or communications.
  • New leading practices in compliance that have emerged.

Participants will gain insights on benefits and challenges associated with the new FCPA corporate enforcement policy.
