There are a variety of monetary remedies (i.e., damages) that may come in to play in trademark infringement matters, including various forms of economic damages and recovery of defendant profits. In addition, barriers to recovery of defendant profits may be somewhat lower as a result of the Supreme Court’s Romag decision.

In order to be in the best position to pursue damages or defend against claims for damages in trademark infringement matters, it is important to understand the types of potentially available damages, issues and strategies related to the calculation of various types of trademark damages, and strategies for pursing damages-related discovery in trademark matters.
